This year marks the 10th anniversary of the issuance of the revised regulations under section 403(b), and the landscape in which 403(b) plans operate continues to evolve. In this presentation, we will examine some of the challenges facing 403(b) plan sponsors, including:
· recent developments affecting plan documents, including the introduction of pre-approved documents and the end of the remedial amendment period;
· typical compliance problems we are still seeing in 403(b) plan operation under the Code and ERISA;
· our experience in fixing operational failures under EPCRS;
· recent litigation involving 403(b) plans;
· trends in 403(b) plan design.
Our Speakers:
Evan Giller, Attorney, Boutwell Fay, LLP
Evan has worked in the field of employee benefits law and ERISA for over 25 years, specializing in the retirement and deferred compensation plans of tax-exempt organizations and governmental employers. He has extensive experience advising employers and plan service providers on a wide range of plan issues, including plan design, plan documents, operational issues, corrections and fiduciary responsibility, and has particular expertise regarding 403(b) and 457 plans. In addition, Evan’s practice includes advising financial institutions on issues relating to the design nd regulation of annuity products, in particular annuities used to fund retirement plans. Evan attended Buffalo University Law School and was admitted to the Bar in 1979.
Brodie Wood, Senior Vice President, Not-for-Profits Markets, Transamerica Retirement Solutions
In his role, Mr. Wood leads and is responsible for the company's not-for-profit busines and product dvelopment. Earlier as VP of Participant Counseling Organization, his group was dedicated to delivering employee education and retirement planning for plan participants. He has been involved in the retirement plan field for the past 15 years helping participants become retirement ready. Mr. Wood earned his BA from Utah State University and his MBA from Brigham Young University in 2002. He is a Six Sigma Green Belt and holds multiple FINRA designations.
