I’ll See You in Court! ERISA Litigation
Update 2016/2017
Our Presentation:
For a whirlwind – and hopefully informative – tour of the many developments in ERISA Land in 2016 and 2017, come join us as we learn from the mistakes of others and discover a few new ways to help our clients avoid ending up on the wrong side of the “versus” in a case caption.
Tim Verrall, Esq. will cover current litigation concerns, such as:
- · The short-handed Supreme Court will be considering important issues involving the funding of church-sponsored pension plans.
- · ERISA claims in 2016 and 2017 have a certain air of familiarity about them
- · In the lower courts, colleges and universities are increasingly finding themselves in the same crosshairs that private-sector employers have been dealing with for years
- · DOL’s on-again/off-again fiduciary rule remains in play under the new administration and subject to continuing judicial review in several courts
- · Cases like Tackett, Gobeille, Monanile, Tibble, Dudenhoefer, and Spokeo continue to reverberate
We are told that variety is the spice of life. If that is the case, 2017 is shaping up to be a very spicy year indeed on the ERISA litigation front. Over the past few years, enterprising lawyers have been hard at work in their dungeon laboratories, in search of the latest novel theories to turn up the heat on plan fiduciaries, and their new creations are even now lurching into courts across the country.
For a whirlwind – and hopefully informative – tour of the many developments in ERISA Land in 2016 and 2017, come join us as we learn from the mistakes of others and discover a few new ways to help our clients avoid ending up on the wrong side of the “versus” in a case caption.
